By accessing or purchasing from GNAR Optics (“GNAR,” “we,” “us,” or “our”), you agree to the following Terms & Conditions.
1. Products & Use
GNAR Optics products are designed for action sports and lifestyle use. Customers acknowledge that activities such as skateboarding, snowboarding, skiing, cycling, and similar sports involve inherent risks.
GNAR products are not safety equipment and are not intended to prevent injury.
2. Orders & Payments
All prices are listed in [CAD/USD] unless otherwise stated. GNAR reserves the right to modify pricing, product availability, and specifications at any time without notice.
Orders may be canceled or limited at GNAR’s discretion, including in cases of suspected fraud or abuse.
3. Shipping & Delivery
Shipping times are estimates and not guaranteed. GNAR is not responsible for delays caused by carriers, customs, weather, or force majeure events.
Risk of loss transfers to the customer upon delivery.
4. Returns Policy
Unused, unworn products in original condition may be eligible for return within 30 days of delivery, subject to approval.
Return shipping costs are the responsibility of the customer unless otherwise required by law.
Clearance items, promotional items, and gift cards are final sale.
5. Limited Warranty
GNAR Optics provides a 30-day Limited Warranty covering manufacturing defects only, beginning from the date of original purchase.
This warranty does not cover:
• Crashes, impacts, accidents, or abuse
• Scratches, scuffs, or cosmetic wear
• Heat, fire, or chemical damage
• Improper use, modification, or unauthorized repair
Warranty claims require proof of purchase and are subject to inspection and approval by GNAR.
No cash refunds are issued for warranty claims.
6. Crash Replacement Discount
GNAR may offer a Crash Replacement Discount as a goodwill program for non-warranty damage.
This program:
• Is not a warranty
• Is limited to one use per customer per 12 months
• Cannot be combined with other promotions
• May be modified or discontinued at GNAR’s discretion
7. Intellectual Property
All content, trademarks, logos, designs, and product imagery are the exclusive property of GNAR Optics and may not be used, reproduced, or distributed without prior written consent.
8. User Conduct
Customers agree not to:
• Submit false warranty claims
• Abuse replacement or discount programs
• Misrepresent purchase information
• Engage in fraudulent or unlawful activity
GNAR reserves the right to refuse service or cancel orders for violations of these Terms.
9. Limitation of Liability
To the maximum extent permitted by law, GNAR shall not be liable for indirect, incidental, or consequential damages arising from the use or misuse of its products.
Total liability shall not exceed the amount paid for the Product.
10. Indemnification
You agree to indemnify and hold harmless GNAR Optics from any claims, damages, or expenses arising from your misuse of the Products or violation of these Terms.
11. Governing Law
These Terms & Conditions are governed by the laws of the jurisdiction in which GNAR Optics operates, without regard to conflict of law principles.
12. Changes to Terms
GNAR reserves the right to update or modify these Terms at any time. Continued use of the website or Products constitutes acceptance of the revised Terms.
